1) MONTHLY or WEEKLY: All rentals are priced according to a 30-day rate and a 7-day rate and Renters are required to choose their rental period prior to placing the order. Rentals may be extended provided Props are not reserved by other Renters immediately after initial rental period, but Modernous cannot guarantee availability past the initial rental period.
2) Client is required to pay in full upon checking out of Modernous Prop House website. However, the chosen rental period will begin on the confirmed delivery/pick up date.
3) Modernous preauthorize the client’s credit card at double the rental for a security deposit and any damages or fees will be charged to the card as outlined below in the event of damage or late returns.
4) Renter is liable for any damage to, or soiling of, all Props rented from Modernous and will be charged the full repair price, plus an hourly rate for our coordination of said repair.
5) There will be no animals or pets of any kind on site which Props are on site.
6) If any Props are damaged beyond repair during the rental period, Renter will be charged 1.5 times the original retail cost to replace and cover the cost of our time to source new Props.
7) Renter is liable for any stolen or lost Props and will be charged 1.5 times original retail cost of rented Props that are not returned for any reason.
8) Accrued rental charges cannot be applied against the purchase or cost of repair or damaged, lost, or stolen Props.
9) If Renter returns Props beyond the original rental period and Modernous did not approve an extension of the rental period, Modernous will charge another full week of rent at 1.5X the original rental rate to the credit card on file.
a) Renter is considered to have taken delivery of the Props while picking up at warehouse OR after Modernous drops them off at job site. Props are considered returned once they are returned to their place in the warehouse OR when Modernous picks them up on site. Renter assumes all risk of loss from the time the Props are released to the Renter. From the time Renter takes delivery of the Props rented, until the Props are returned to Modernous, the Renter accepts total responsibility, including, but not limited to all risks and losses while in transit, at all locations, while in storage, and while on Renter’s premises.
b) Renter will take all necessary precautions during the progress of its work, including the use of the Props rented to it by Modernous to protect all persons and property from injury and damages. Only Renter’s qualified employees or agents shall use or handle the Props.
c) Renter will not sublease or lend any of the Props to another party. If Renter does sublease or lend any of the Props to another party, both parties will be obligated to Modernous for full rental cost until the Props are returned to Modernous. In the event that there is loss or damage during this period, the Renter will be fully responsible, regardless of any agreement that the Renter might have with the other party.
d) Renter agrees that it will not alter the Props in any manner. Should the Props be altered, Renter takes full responsibility for any cost associated with returning the Props to their prior condition or replacing them, plus an hourly fee for time spent coordinating repairs.
e) Renter understands that the Props rented from Modernous are set dressing and décor. They are not to be rented or used with any other purpose.
10) Modernous will happily exchange or return any rented Props, however Renter will face a 20% restocking fee, plus any delivery/pick up charges if request for exchange/return is made after initial order has been delivered. We have conveniently listed all product details & dimensions on our site to ensure you’re able to confidently select the appropriate pieces for your project.
11) In the unlikely event that a reserved piece is damaged prior to the confirmed rental period, Modernous reserves the right to substitute a similar piece, or refund the amount of that piece. Modernous will contact the Renter to discuss any substitutions needed prior to delivery/pick up.
12) If a Renter wishes to add additional pieces to an order that has already been delivered, it must be arranged by contacting prophouse@modernous.com and separate delivery fees will apply. Adding additional pieces to an order that has not been delivered can be accomplished for no additional delivery charge.
13) There will be no animals or pets of any kind on site with rented furniture.
14) Renter shall be solely responsible for obtaining any licenses or clearances necessary to display trademarks or other protected intellectual property in connection with the Props. Renter agrees to defend, indemnify, and hold Lessor harmless from any and all Claims arising out of Renter’s failure to comply with the foregoing.
Modernous Delivery & Removal
15) Modernous requires a $750 minimum (plus sales tax) rental order for orders requiring delivery.
16) There will be no animals or pets of any kind on site during delivery or pick up.
17) Delivery fees for locations within Seattle and Bellevue are a fixed rate of $650 (includes delivery and removal of Props at the end of the project.) Delivery service includes:
a) Time and labor involved in pulling, preparing, and packing the truck prior to the delivery time slot
b) Time, mileage and gas traveling to the job site
c) Unloading Props from truck
d) Setting up Props in the designated areas one time
e) Time, mileage and gas traveling back to warehouse
f) Time, mileage and gas returning to the site to remove Props using truck
g) Time, mileage and gas traveling back to warehouse
h) Time and labor to unload truck and place Props back in warehouse
i) Use of Modernous truck
j) All required moving supplies
18) Delivery in outlying areas is subject to surcharges based on driving time to the area. Should you require delivery outside of Seattle & Bellevue, please contact prophouse@modernous.com to coordinate and price.
19) Deliveries are offered between 9am - 2pm. Client will receive a call 15 minutes prior to delivery.
20) Additional surcharge will apply to any delivery requiring the following:
a) an elevator + $125
b) long carry + $125
c) stairs + $125
d) any type of restricted access (construction, landscaping, etc.)
21) It is the Renter’s responsibility to provide the appropriate delivery notes during checking out. If proper disclosures are not made prior to delivery, surcharges will be added retroactively once delivery is complete.
22) It is the Renter’s responsibility to ensure furniture selected will fit into the home, elevator or hallways. If additional time is incurred based on the difficulty of delivery, Renter will be notified of additional charges and billed accordingly.
23) Client is required to provide Modernous with keys, access code and any other information reasonably required for Modernous to make the delivery or provide an on-site contact to meet the delivery. There must not be any conditions on the Property that in any way hinder Modernous’s access for delivery. If Modernous is not able to access the Property at the time scheduled, then time waiting for access is charged at Modernous’ hourly rate of $125/hour; or in Modernous’s sole discretion the delivery may be rescheduled by Modernous, and Renter will be responsible to pay the costs incurred due to the rescheduling.
24) All Props are set in place according to direction given on-site by Renter one time.
25) If the Delivery team is asked to move furniture after it is initially set, or if you need our delivery crew to spend extra time on site making sure your project is perfectly set, Renter will be retroactively billed $65 for each additional 30 minutes.
26) Lamps, art & smaller bins of decorative Props are placed in a central location for on-site contact to unpack and place. Delivery crew is not responsible for hanging artwork, styling pillows, styling smalls, making beds, putting lamps together, or making layout adjustments.
27) Please add $65 for each additional 30 mins if you need our delivery crew to spend extra time on site making sure your project is perfectly set.
28) Client is required to keep the bins, bags and packing materials to prepare Props for pick-up. If any bins or clear zipper bags are not returned after the pickup is complete, Renter will be billed $25 per bin or clear zipper bag that is not returned.
29) Styling services must be reserved separately if Renter wishes to include onsite styling. To inquire, please contact prophouse@modernous.com
30) Modernous’s delivery team is only contracted to set up and handle Modernous Props. Any set-up or movement of Renter’s own property by Modernous staff is strictly prohibited.
31) Modernous delivery crew is not responsible for hanging artwork, but we are happy to assist the onsite contact with any large or heavy pieces of Modernous-owned artwork
32) All rentals will be automatically scheduled for removal prior to delivery and the inventory will show up on our website as available immediately after that.
33) It is Renter’s sole responsibility to provide a 7-day notice to Modernous if the Renter wishes to extend the rental period; Modernous will make every effort to extend the rental as requested, but cannot guarantee availability past the initial rental period.
34) All Props must be prepared for removal (art removed from walls, pillows & towels bagged, bedding bagged, décor rewrapped and packed in bins, lamps unplugged & shades removed) prior to our arrival for removal or a $500 packing fee will apply.
Client Transport
35) Should the Renter decide to conduct their own transport for rented Props, the Renter is responsible for providing safe packing and transportation of Props during pick-up and delivery.
36) It is the Renter’s responsibility to provide the proper packing materials and bring enough manpower to move and secure all Props properly without damage.
37) Modernous staff will not load or pack truck. If the Delivery team is asked to move or pack Renter’s vehicle, Renter will be retroactively billed $35 for each 15-minute increment.
38) Modernous is not responsible for damages to Renter’s vehicle.
39) The Renter must contact Modernous at least 3 days prior to pick-up and drop-off to schedule a time window for arrival.
40) The Renter is solely responsible for paying for any damage to the Props during transportation and will be charged the full repair price, plus an hourly rate for our coordination of said repair.
41) If any rented Props are damaged beyond repair, Renter will be charged 1.5 times the original retail cost to replace and cover the cost of our time to source new Props.
42) Should Renter use any third party to transport, Renter takes fully responsibility and liability for Props while off Modernous premises. This includes any loss or damage, and/or any additional rental charges applicable.
Cancellation/Reschedule
43) Please direct any cancellation or re-schedule requests to prophouse@modernous.com
44) If a rental is rescheduled and you would like us to hold the Props for your project, the rental period will begin on the originally scheduled date regardless of rescheduled date, and rental fees will apply for any needed extension. Modernous will make every effort to extend the rental as needed but cannot guarantee availability of all Props past the initial rental period.
45) If Renter would like to reschedule and does not wish to pay rental fees on selected Props from the initial date, the rental order should be cancelled and a new order made on the Modernous website.
46) If a rental is cancelled within 3 business days of its scheduled date, no refunds will be provided.
